ARTICLE III - MEMBERSHIP AND VOTING RIGHTS 
Section 1. Membership

ARTICLE V - COVENANT FOR MAINTENANCE ASSESSMENTS 
Section 1. Creation of Lien and Personal Obligation of Assessments 
  • Agreement to pay the Association:

The assessments "shall be a charge on the land and shall be a continuing lien upon the property..."

Section 2. Purpose of Assessments
The assessments levied by the Association shall be used exclusively for the purpose of promoting the recreation, health, safety and welfare of the residents...

Section 3. Basis and Amount of Annual Assessments
January 2006 - Fees were increased to $120 for the first lot and $45 for each additional lot in the same subdivision.

Section 4. Special Assessments for Capital Improvements
Special Assessments may be levied "... for the purpose of defraying, in whole or in part, the cost of any construction or reconstruction, unexpected repair or replacement of a described capital improvement upon the Common Properties..." (subject to a vote) 

Section 5. Change in Basis and Maximum of Annual Assessments
May be changed subject to 2/3 of the votes of the members who are voting. 

Section 6. Quorum for any Action Authorized Under Section 4 and 5
First Meeting - 60% of all the votes of the membership 
Subsequent Meetings - must adhere to notice requirements - the quorum shall be 1/2 of the required quorum of the preceding meeting

Section 7. Date and Commencement of Annual Assessments.  Due Dates. 
Due on April 1st - no prorated fees.  

Section 8. Duties of the Board of Directors
The Board of Directors shall prepare a roster of the properties and assessments at least 30 days in advance of the due date. 

Section 9. Effect of Non-Payment of Assessment 
If not paid by due date, they are considered delinquent, subject to interest and collection fees.

If not paid within 30 days - a penalty fee of $2 to be added, followed by 6% per annum

ARTICLE VII - BUILDING AND USE LIMITATOINS

Section 1.  Residential purposes, no businesses or manufacturing, 2½ stories in height max, one garage or boathouse.
